A shoe size is not in inches.
If you are shoe size 13 it doesn't penny-pinching your feet are 13 inches, it only means you are shoe size number 13. You do realise that don't you?
And the US and the UK use different scales for shoe sizes, but neither of them is within inches. They are just numbers.
As for the 38 inch pant being too small, that's in recent times because of variation contained by tailoring styles from place to place. Don't you ever find that in one store you come up are 38 but within other places you might come up as 36 or 40. It's just because the trade processes are different.

shoe sizes arent in inches but pant are... however i heard explicitly the US they on purpose kind clothes bigger to make relatives think theyre thinner than they are...
have said that, sizes vary contained by shops so i would reccomend trying things on before buying them.
